Tentative Rulings for Friday, May 24, 2013
1. P14356 Nicol Trust
The 8th Accounting and requested fees are granted as prayed. No appearances are required.
2. P15284 Estate of Harold Thompson
The Petition to Confirm Settlement Agreement, as clarified and modified at the hearing on the record in open court on April 26, 2013, is granted. No appearances are required.
3. P15305 Milnes Trust
Appearance of Mr. Wayne Milnes and Mr. Pruett are required for hearing. The court requires a status of the accounting and the obtaining of the financial records relating to the trust.
4. P15310 Estate of Patricia Latapie-Wilson
The Petition to Determine Ownership of Estate Property is dropped. Petitioner failed to file a serve an amended notice of hearing and file a signed and dated proof of service with the court as required by this court’s order on May 3, 2013. Petitioner may re-notice the present petition in the future if desired. No appearances are required.
5. P15386 Estate of John Stark
The Petition for Final Distribution is granted as prayed. No appearances are required.
6. P15410 Conservatorship of Michol Stephenson
The Petition for Attorney’s Fees is granted as prayed. Ms. Wilkerson is hereby relieved as counsel. No appearances are required.

The Petition to Administer Estate is continued on the court’s own motion to June 14, 2013, at 9:00 a.m. The court is missing the original will. No appearances are required.
9. P12190 Retherford Trust
The 16th Accounting and requested fees is granted as prayed. The request to withdraw $20,000 from the blocked account is granted. No appearances are required.

This is the Court’s tentative ruling. Attorneys and parties are urged to review the tentative rulings prior to the scheduled hearing, notify the opposing side if they intend to appear at the hearing and notify the law and motion/probate judicial assistant at (530) 265-1273 by 4:00 p.m. the court day preceding the hearing. Local Rule 8.27.
Unless the court orders otherwise, the court does not provide court reporters for probate hearings or proceedings at court expense. Any litigant who wants a record of the hearing or proceeding must arrange for the presence of a court reporter at his or her expense. Local Rule 10.00.3B
EXECUTIVE ORDER NO. 135: INTERIM CHANGE TO LOCAL RULE 4.05.3
Local Rule 4.05.3 A. is hereby changed to read “Tentative Rulings will be available by 10:00 a.m. of the court day before each regularly scheduled law and motion calendar and posted on the Court’s website (www.nevadacountycourts.com) not later than 2:00 p.m. of the court day before the scheduled hearing.”
This change will become effective on April 1, 2013 and will be reflected in the next regular revision of the Local Rules of this Court.
