Tentative Rulings for Friday, May 17, 2013
1. P14901 Estate of Harriet Fels
The Petition for Final Distribution is continued on the courtís own motion to June 7, 2013, at 9:00 a.m. There is no proof of service of the petition on the five creditors whom will be receiving pro rata distributions. Petitioner shall serve the five creditors and file a proof of service with the court by May 24, 2013. No appearances are required.
2. P15361 Estate of Charles Clarke
The Petition for Final Distribution is granted as prayed. No appearances are required.
3. P15443 Conservatorship of Ruth Rose
Appearances are required for hearing on the Petition to Appoint Conservator of the Person.
4. P15464 Estate of Sylver Frank
The Petition to Administer Estate is continued on the courtís own motion to June 7, 2103, at 9:00 a.m. The court requires a copy of the trust or a declaration regarding the beneficiaries of the trust as required by Local Rule 8.30. No appearances are required.
5. P15456 Pendleton Trust
Appearances are required for hearing on the Petition for Relief from Breach of Trust. The court notes that the notice of hearing improperly set this matter in Department 3. This matter will be heard at 9:00 a.m. in Department 6. Additionally, the court notes that a copy of the trust was not attached to the petition.

Attorneys and parties are urged to review the tentative rulings prior to the scheduled hearing, notify the opposing side if they intend to appear at the hearing and notify the law and motion/probate judicial assistant at (530) 265-1273 by 4:00 p.m. the court day preceding the hearing. Local Rule 8.27.
Unless the court orders otherwise, the court does not provide court reporters for probate hearings or proceedings at court expense. Any litigant who wants a record of the hearing or proceeding must arrange for the presence of a court reporter at his or her expense. Local Rule 10.00.3B
EXECUTIVE ORDER NO. 135: INTERIM CHANGE TO LOCAL RULE 4.05.3
Local Rule 4.05.3 A. is hereby changed to read ďTentative Rulings will be available by 10:00 a.m. of the court day before each regularly scheduled law and motion calendar and posted on the Courtís website (www.nevadacountycourts.com) not later than 2:00 p.m. of the court day before the scheduled hearing.Ē
This change will become effective on April 1, 2013 and will be reflected in the next regular revision of the Local Rules of this Court.
